Types of procedures

Below threshold procurement

  • Features: since 11.05.2022 this procedure is no longer distinguished as a separate one — Order of SE «PROZORRO» dated 10.05.2022 № 13 removed the concept of «below threshold procurement» from Instruction № 10, and on the platform it is labelled together with «Simple procurement» as a single type — «Simple/Below threshold procurement». For the current threshold values, see «Simple procurement» below. Complaints to the Antimonopoly Committee of Ukraine cannot be filed for this procedure
  • Tender stages: Enquiry period, Call for proposals, Auction, Qualification, Contract signing
  • Minimum number of participants: 1
  • Proposal submission term: during the «Call for proposals» stage
  • Questions submission term: during the «Enquiry period» stage
  • Claim to the Customer regarding tender conditions submission term: during the «Enquiry period» stage
  • Claim to the Customer at the «Qualification» stage submission term: within 2 working days from the disqualification of a participant, or the determination of the winner

Simple procurement

  • Features: applies to the procurement of goods and services valued up to 200 thousand UAH, and works up to 1.5 million UAH; for Customers in natural monopoly sectors — up to 1 million UAH for goods/services and up to 5 million UAH for works. Complaints to the Antimonopoly Committee of Ukraine cannot be filed for this procedure

The thresholds are the same as for «Open procurement» above. The main difference is that the procedure can conclude even with just one participant: in that case no auction is held, and the Customer proceeds directly to reviewing the single submitted proposal

Open procurement published in English

  • Features: applies to the procurement of goods and services valued over a sum equivalent to 133 thousand euros, and works over 5,150 thousand euros. Some material information is duplicated in English

Reference

For the duration of the martial law regime, the use of this procedure is not mandatory and is not limited by the value of the procurement — the Customer may choose it voluntarily regardless of the procurement's value.

  • Tender stages: Call for proposals, Prequalification, Auction, Qualification, Contract signing
  • Minimum number of participants: 2
  • Proposal submission term: during the «Call for proposals» stage

  • Complaint to the AMCU at the «Qualification» stage submission term: within 10 days from the disqualification of a participant, or the determination of the winner

Procurement without using an electronic system

  • Features: a non-competitive procedure, the bidding for which is conducted outside the Prozorro system. The procedure is applied in accordance with paragraph 4, item 1, article 2 of the Law of Ukraine «On Public Procurement». The Customer publishes a decision on the intent to conclude a contract and immediately enters information about the Winner. It is not possible to appeal the decision regarding the winner
  • Tender stages: none
  • Minimum number of participants: 1
  • Winner determination appeal term: it is not possible to appeal the decision regarding the determination of the winner

Negotiations procedure

  • Features: a non-competitive procedure — the negotiations themselves are conducted outside the Prozorro system, while publication of the notice of intent to conclude a contract, the winner's supporting documents, and the appeal process are handled through the electronic procurement system. Since 01.09.2026, the grounds for applying this procedure are defined by the updated item 13 of the Peculiarities (Resolution of the Cabinet of Ministers № 1178, as amended by Resolution № 957 dated 15.07.2026) — in particular, if the open procurement did not take place due to the absence of proposals, there is a lack of competition for technical reasons, an urgent need arose due to unforeseen circumstances, or an additional volume is purchased from the same supplier. The Customer publishes the notice of intent to conclude a contract within 1 calendar day after the decision following the negotiations; the winner must publish supporting documents in the system within 4 calendar days from the publication of the notice
  • Tender stages: none
  • Minimum number of participants: 1
  • Winner determination appeal term: within 5 days from the day the notice of intent to conclude a contract is published (the waiting period, «stand-still»). The contract is concluded not earlier than 5 calendar days from the day the notice is published, provided there are no unresolved complaints. If the contract is not signed within 35 days from the day the notice is published, the procedure is cancelled

Negotiations procedure (quick)

  • Features: the same negotiation procedure under item 13 of the Peculiarities as above, but for a narrower list of «urgent» grounds — an urgent need arising from the circumstances specified in paragraphs 2-5 of sub-item 3 of item 13 of the Peculiarities, as well as the procurement of crude oil, oil products, electric energy (supply/distribution), thermal energy, hot water, electronic communication services, centralised water supply/drainage, or general-use railway transportation — and has shortened terms
  • Winner determination appeal term: within 3 days from the day the notice of intent to conclude a contract is published (the waiting period, «stand-still»). The contract is concluded not earlier than 3 calendar days from the day the notice is published, provided there are no unresolved complaints. If the contract is not signed within 20 days from the day the notice is published, the procedure is cancelled

Reference

The Negotiations procedure (quick) differs from the plain Negotiations procedure by shorter terms for the appeal, contract conclusion and signing — it applies only to the list of urgent/special grounds defined by item 13 of the Peculiarities. These changes (in force since 01.09.2026) do not apply to the «Negotiations procedure for defense» below — it is regulated by a separate law.

Negotiations procedure for defense

  • Features: This procedure fully repeats the «Open procurement» procedure, with the exception of the appeal term and the minimum number of participants. It is regulated by a separate Law of Ukraine «On Defense Procurement»
  • Tender stages: Call for proposals, Auction, Qualification, Contract signing
  • Minimum number of participants: 1
  • Proposal submission term: during the «Call for proposals» stage
  • Questions submission term: not later than 3 working days before the end of the «Call for proposals» stage
  • Claim to the Customer regarding tender conditions submission term: not later than 3 working days before the end of the «Call for proposals» stage
  • Complaint to the AMCU regarding tender conditions submission term: not later than 2 working days before the end of the «Call for proposals» stage
  • Claim to the Customer at the «Qualification» stage submission term: within 4 working days from the disqualification, or the determination of the winner
  • Complaint to the AMCU at the «Qualification» stage submission term: within 4 working days from the determination of the winner

Competitive dialogue

  • Features: this procedure is applied when the Customer cannot determine the technical and quality characteristics of works, or determine the type of services, and is therefore unable to announce a competitive tender straight away. Competitive dialogue is conducted in 2 stages. At the first stage, participants submit their proposals without specifying a price. The Customer analyses the proposals received and decides which of the participants to admit to the next, second stage. At the second stage, the participants who qualified at the first stage take part in the competitive tender with an auction

first stage

  • Tender stages: Call for proposals, Prequalification
  • Minimum number of participants: 3
  • Proposal submission term: during the «Call for proposals» stage
  • Questions submission term: not later than 10 days before the end of the «Call for proposals» stage
  • Claim to the Customer regarding tender conditions submission term: not later than 10 days before the end of the «Call for proposals» stage
  • Complaint to the AMCU regarding tender conditions submission term: not later than 4 days before the end of the «Call for proposals» stage
  • Claim to the Customer, or complaint to the AMCU at the «Prequalification» stage submission term: within 5 days after the qualification of all participants

  • Complaint to the AMCU at the «Qualification» stage submission term: within 10 days from the disqualification of a participant, or the determination of the winner

Competitive dialogue published in English

Reference

Competitive dialogue published in English fully repeats the «plain Competitive dialogue» procedure, except for the presence of a «Prequalification» stage at the 2nd stage.

Framework agreement

  • Features: this procedure is organised by the Customer to determine a limited number of suppliers of goods, works or services for its future procurements of a specific product, type of work, or service, valued over 200 thousand UAH for goods/services, and over 1.5 million UAH for works. In this procurement, several participants are determined as winners, with whom the Customer concludes a framework agreement. In the future, the Customer may publish tenders of the type «Mini-competition under framework agreement», to which suppliers who became members of the framework agreement are invited

General procedure for concluding a framework agreement:

  1. The Customer publishes a tender «Framework agreement», to which any participant in the Prozorro system is invited. In doing so, the Customer determines:
  • the maximum number of possible winners, but not less than three
  • the term of validity of the framework agreement, but not more than 4 years
  1. Based on the results of the Auction, the Customer qualifies participants in order from the lowest price to the highest, and determines the winners of the procurement until the number of winners reaches the maximum number defined when the procurement was created
  2. Within 5 calendar days of being determined winners of the bidding, participants in the procurement must upload unit prices for the positions (goods, works, or services) to their proposal, based on the auction results
  3. Based on the results of the tender, a framework agreement is formed, specifying the members of the framework agreement, as well as the final prices for the positions that were the subject of the procurement for each participant. These prices are subsequently used to calculate the maximum value of a proposal that a participant may specify in future tenders
  4. The Customer may exclude a participant from the list of framework agreement members
  5. The Customer may change the prices of framework agreement Participants upward or downward, in cases defined by the Law
  • Tender stages: Call for proposals, Prequalification, Auction, Qualification, Contract signing
  • Claim to the Customer at the «Qualification» stage submission term: within 10 days from the disqualification of a participant, or the determination of the winner
  • Complaint to the AMCU at the «Qualification» stage submission term: within 10 days from the disqualification of a participant, or the determination of the winner

Mini-competition under framework agreement

  • Features: this procedure is applied for the procurement of goods, works, or services among the participants of a Framework agreement, valued over 200 thousand UAH for goods/services, and over 1.5 million UAH for works

General features:

  1. The tender is created with a reference to a specific Framework agreement
  2. Only participants of the Framework agreement can take part in the procurement
  3. A participant cannot specify a value for their proposal greater than the sum of the products of the quantity of units of the positions being procured and the unit price they specified for those positions in the Framework agreement referenced by the procurement

  • Features: a procedure for the procurement of energy service contracts (ESCO agreements). It is conducted as a competitive procedure with an auction and a Prequalification stage — in the same way as «Open procurement published in English» and «Competitive dialogue published in English». The law also allows energy services to be procured without bidding, or through the Negotiations procedure, provided the contractor guarantees savings of no less than 50% of costs compared to the baseline consumption level, and has confirmed experience delivering similar projects

Price Quotation

  • Features: a simplified procedure for procuring goods through the Prozorro Market electronic catalogue, without conducting a tender in the classic sense. It applies to goods valued from 50 thousand to 200 thousand UAH per classifier code (up to 1 million UAH for Customers in natural monopoly sectors); goods valued up to 50 thousand UAH are purchased by a direct contract through the catalogue, without a price quotation request. No auction is held — the disclosure of the submitted price quotations is itself the final stage of determining the price
  • Tender stages: none
